These Terms govern your purchase and use of digital products from VIEWSPIKE LLC, a Massachusetts limited liability company.
01 Who we are
VIEWSPIKE LLC creates and sells paid digital educational products to consumers. We operate consumer storefronts under various brand names.
02 Eligibility
You must be at least 18 years old to purchase.
03 Products and license
Digital materials (guides, courses, templates, checklists, workbooks) delivered electronically. We grant a personal, non-exclusive, non-transferable, revocable license for personal, non-commercial use. No resale, redistribution, sublicensing, public sharing, or derivative works without written permission.
04 Payment
Handled by our checkout provider and processed by third-party payment processors. Prices in USD at checkout. You authorize the charge plus applicable taxes at purchase.
05 Refunds
Governed by our Refund Policy, incorporated into these Terms.
06 Educational use; no professional advice
Products are for educational and informational purposes only. Not a substitute for professional medical, mental health, psychological, legal, financial, or other professional advice. We do not guarantee any specific result or outcome. If you are in crisis, call or text 988 (US and Canada) or contact your local emergency services.
07 Intellectual property
Owned by VIEWSPIKE LLC or its licensors.
08 Your submissions
If you send us a review, testimonial, survey response, comment, or other feedback, you keep ownership of it and grant VIEWSPIKE LLC a worldwide, perpetual, irrevocable, royalty-free, transferable, sublicensable license to use, reproduce, adapt, abridge, translate, publish, and display it, in whole or in part, in any medium, including marketing. The license covers the first name, last initial, and general location you supply, and any image or recording you choose to include. We may edit for length and clarity without altering meaning. We are not obligated to use any submission and may remove it at any time.
You represent that each submission reflects your own honest experience, is truthful, is not confidential, and does not infringe any third party's rights. Do not submit health information or other sensitive personal information. To withdraw permission for future use, contact us; we cannot recall materials already published or distributed.
09 Acceptable use
No unauthorized access, interference, or unlawful use.
10 Disclaimer of warranties
Provided "as is" and "as available" without warranties to the fullest extent permitted by law.
11 Limitation of liability
No indirect, incidental, special, consequential, or punitive damages. Total liability capped at the amount you paid for the product at issue.
12 Third-party services
Not responsible for third-party content or practices.
13 Changes
Effective when posted; the "Last updated" date reflects the current version.
14 Governing law and dispute resolution
These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to its conflict-of-laws principles.
Informal resolution first. Before filing any claim, you agree to contact us through our contact form and give us 30 days to work the issue out with you. Most concerns are resolved this way.
Binding individual arbitration. Any dispute arising out of or relating to these Terms, the site, or any purchase from the site that is not resolved informally shall be resolved by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court, except that either party may bring an individual claim in small-claims court. The arbitration will be conducted on an individual basis, and the arbitrator's decision will be final and binding. Filing fees that those rules require us to cover will be covered by us.
Class action and jury waiver. You and we each waive the right to a trial by jury and the right to participate in a class action, collective action, or representative proceeding. Claims may be brought only in an individual capacity. Nothing in this section waives any right you may have to seek public injunctive relief where that right cannot be waived under applicable law, or to report issues to government agencies.
Opt-out. You may opt out of this arbitration agreement within 30 days of first accepting these Terms, stating that you opt out of arbitration, by writing to us by mail at: VIEWSPIKE LLC, 500 Cummings Center, Suite 6500, Beverly, MA 01915, United States. If you opt out, or if this arbitration agreement is found unenforceable, disputes shall be resolved exclusively in the state or federal courts located in the Commonwealth of Massachusetts, and you consent to the personal jurisdiction of those courts.
